Yes she was there.Claire just wanted Khim to pull over. Khim was driving drunk and almost passed out. If we go by the intentions of Claire, then I would say Claire shudnt be blamed for the accident as she didnt intend to hurt Khim. If Khim was sober she wud've pulled over.
