They aren't specifically using that case at all. It's way more general because the nth room is definitely not the first time or the only time illegal videos/filmings happened. The issue of illegal videos/filming has even been brought up by older kdramas like The Player(2018)

What if it was koo dong koo (JBR's friend)? Someone mentioned earlier in comments it could be him with some reasons but also in the recent ep, the killer was shown wearing pants similar to the courier which had similar clothes as his KDK, whilst both killer and KDK also seem to wear similar jacket.
Also KDK didn't go with JBR when he was told to his excuse was he wants to be like Alfred Hitchcock who is a scriptwriter known for suspense and thriller films.

I loved the start of the drama and where it was going but then progressively it started to plateau and after the car accident episode I've just lost interest in this drama. I'm not even sure if I wanna finish the rest of it, even though i know how it'll end, but props to the cast they did really well, especially moon gayoung!
