There is a thing called assault, and there is a thing called dying from your own negligence. Mixing the two together doesn’t magically create attempted murder. She could be tried, but in this case, it was logical that she was not convicted for that charge and instead for 2 separate charges, intent matters and there is a lot of nuance involved.

The victim died because of her own jaywalking negligence, not from the stone hit. That breaks causation, so it doesn’t escalate to manslaughter or attempted murder. It stays as assault + a separate accident, which makes a short sentence realistic.
