Technically, I expect as much. Coherent, lucid , cognizant ('though intoxicated) Porsche's actions absolve Kinn from the possible liability of SA. So Porsche doesn't have the means to win should he go to court (I don't think he will).
But SA is more than just the physical violation. The most important violation is the sense of self of the victim. Had it been anyone else, and not Porsche, I would have felt differently. Porsche is someone who knows how to exact revenge if someone violated is bottom line. Kinn may have crossed the line, but not his bottom line.

SA is a very personal topic for most people. Maybe they have gone through it or know people who had. Killing and torture is visceral, therefore, not as personal. For most, 'though, it's the "idealism" that drives such reaction. I think idealism needs a dose of realism and open-mindedness. If they are willing to look at the topic in someone else's (preferably opposing) perspective, they will surely realise some insights and, hopefully, grow better in the process.

I have dropped too many gritty, war-related movies that are too heavy for me. I did not complain about it, because I knew what I signed up for when I started watching it.
