I agree with you. Yes, she shouldn't get a free pass for using a kid. But we still don't know how the drama will turn out, so I think we should wait and see and then decide if the drama is good or bad. Maybe she will realize her mistake or maybe she won't use the kid or maybe the writers will screw up and give us a really bad drama. All we can do is wait and see.

I get why lot of people don't like this drama, and using a kid to get back at his parents is just messed up but I think from a drama point of view it actually shows how broken her character must be that she thinks it ok to use a kid for her revenge .
