Yeah its a sad reality that since the testimony of the victim might be the only available evidence, which makes it the focus of the attack for the defense. And this is typically done by undermining the survivor’s credibility and reliability, and their story’s plausibility and consistency.

Idk where you live with re-victimization does occur. Most women are treated as liars until it is proven that they are telling the truth and if it does go to court most victims are forced to relive the trauma again when they take the witness stand. During the trial, the survivors might be called liars or be accused of fabrication. In most trials, the defense has to bring doubt to the prosecution’s case. In most rape or sexual assault cases, the testimony of the victim might be the only available evidence, which makes it the focus of the attack for the defense. How is this done? It is typically done by undermining the survivor’s credibility and reliability, and their story’s plausibility and consistency. Like we saw in ep 10, the lawyer kept trying to destroy her argument and saying that since she didnt struggle then she must have liked it. Most rape cases are non-violent, yet physical injuries are used as evidence to prove that there was no consent. Survivors most of the time must deal with this while also potentially suffering from the psychological effects of experiencing sexual violence.
