The Reason Lee Jinwook Was Cleared of Rape Allegations: ‘Hesitation Wounds’?

The sexual assault allegations against actor Lee Jinwook are shifting in the direction of a false accusation by the woman. Why did the woman have no choice but to confess to her false accusation? The turning point lies in the photos that the woman herself made public. Professor Lee Jeong-bin, former professor at Seoul National University College of Medicine’s Department of Forensic Medicine (currently a chair professor at Dankook University), stated definitively regarding the photos released by Dispatch, “There is no basis to suspect forced sexual assault.”

First of all, the location of the injuries is unconvincing. Generally, when a woman resists during sexual assault, irregular bruises appear on the inner parts of the arms and legs, and injuries typically occur on the head, collarbone, breasts, genital area, and groin. The areas revealed by the woman were the outer arms, knees, and upper chest—areas not commonly injured during sexual assault. The nature of the wounds is also suspicious.

Professor Lee stated, “The two linear abrasions on both arms are evenly spaced and shallow, suggesting they were caused not by fingernails but by a claw-like artificial tool.” The bruises on the knees also appeared to have been deliberately caused by bumping into something, and were not consistent with blunt force trauma from a fist. If it had been caused by a punch, there would usually be two bruises rather than the single one shown in the photos.

The fact that there were no injuries at all on Lee Jinwook’s body also suggests that it was not a case of forced sexual assault. Ms. A submitted a medical certificate indicating two weeks of treatment, claiming that she was injured during the sexual assault. She stated that she resisted violently, resulting in bodily injuries and torn underwear. However, if a woman resists in such a manner, the man who committed the assault would also typically have “defensive wounds” on his body. Yet, even though police saw Lee Jinwook with his shirt completely removed, they reported that there were no injuries whatsoever.

The injuries on Ms. A’s body are highly likely to be hesitation marks that she inflicted on herself.

Hesitation marks refer to non-lethal self-inflicted wounds. Typically, before a person causes a fatal injury during a suicide attempt, multiple hesitation marks appear on the body. Even if someone resolves to die, they often hesitate before inflicting a fatal wound, and it is during this hesitation that such marks occur. These wounds usually appear on parts of the body that are easily accessible by the individual, and even when found in multiple areas, they tend to be clustered together. They are generally shallow, non-lethal, and parallel in shape. Hesitation marks are most commonly observed on the front of the wrists, inside the elbows, neck, chest, or abdomen.

Hesitation marks can also be fabricated—to stage a homicide as a suicide, or to create an alibi portraying oneself as a “victim of a crime.” However, forensic science can analyze whether such hesitation marks were fabricated. Forensic medicine is the scientific study of the causes, progression, and outcomes of injuries and diseases in order to establish causal relationships. It allows for reasoning about why a wound occurred from a forensic perspective.

For instance, hesitation marks created after death to disguise a homicide as a suicide will show no signs of vital reaction. Because the injury was inflicted postmortem, the body does not exhibit the natural physiological response to trauma. Also, in cases where someone was killed with a knife and the scene was staged to appear as a suicide, the length of the wounds on the victim is often longer than the width of the knife. This is because the victim moved in an attempt to avoid the knife or struggled after being stabbed.

In this way, the marks left on the body can reveal the truth. In Lee Jinwook’s case, it can be determined through forensic analysis that the wounds on Ms. A’s body were not caused by sexual assault. This likely led her to admit to her false accusation. Forensic analysis of the traces left on the body can prove what actually occurred at the scene. Traces contain the truth. Revealing that truth is the power of forensic science.
