It is very obvious that he likes her but there is something keeping him from committing (The mystery why he came back after 5 years) - and he may have subconsciously treated her that way; not knowing it will make her feel so uncomfortable. Yes he didn't ask for the kiss but I do think he should be a bit more careful with her after it happened, no matter whether she remembers it or not. If he still continues to send those signals after it happened (dancing in the rain, touching her face, head etc.), he deserved to be punished.
