In the first episode it is implied by HRF’s father that HY came into their family after he married her mother. So it does look like they are step siblings in the drama as opposed to cousins in the book. She was probably given the He name because they are higher in status

Do you want spoilers from the novel?
In the novel, He Yan gets exposed in the court and when officials get upset and start petitioning the emperor for punishment we find out that in order to protect He Yan from the fact that she joins the army under a different gender, Xiao Jue tells the emperor beforehand that he brought his fiancé (He Yan) along with him to his garrison as he couldn’t bear to part from her. Emperor in the novel is described as a ‘romantic at heart’ so he grants the marriage between Xiao Jue and He Yan. He Yan is totally surprised and caught off guard!
