in ep. 7 it is explained that they hv investigated him, but they can't called him as witness to KSJ's trial as he is the witness to the attorney. Min Soo was the witness that accused Won Taek killed KSJ's daughter. He is also very meticulous in the killing by wearing protective and glove. They can't find any evidence. The Mom make sure all leads to the case was closed. In ep. 5, they also showed the police chief also involved. Kim Moo Chan already had keep him in checked and collect all evidences for 8 years.
KMC also wanted to dragged the Chief as he is involved in the case. It is one way to show 'don't trust the police'. It is not a plot hole,..the fake injury things also one way to influences the citizen to stop voting as the police were given only 15 days to solve the cases and find Gaetal.
