The whole drama is only a story, told by the storyteller. In the third life, he died in her arms after fighting the bad guys. It's not necessarily both died. Remember, in the second life she died drinking poison while he was still alive.
It seems the legal part of this drama is quite a sensitive issue in South Korea, as it concerns the kidnapping of a minor. I think the production company wanted to avoid criticism or unnecessary debates on the legal matter. Therefore, we don't see any scene from Myung Joon's attorney, whether the sentence period is reduced, or if in the future an ex-convict is able to adopt the kidnapping victim, let alone a mere child.
