At this point he is not cheating on her girlfriend, but he is showing interest for the female lead. The fact is that things look like will turn into cheating one way or the other, and that makes a lot of people uncomfortable, but nothing has happened beyond funny interactions. On the other hand, the male lead is not "using" his girlfriend; she is aware that he doesn't love him and he decided to finally date her after her many attempts and because she was a good girlfriend material, specially for him that has never been in love. I don't think she is using him. I think she is a woman who felt lonely surrounded by the expectations of a toxic father and a bad former relationship until she found a man that cared for her (as a professional doctor, but the point is that somebody cares for her at some level). She was vulnerable and found solace with the ML, but he is the one using her to compensate for what her father did to him.
And, the moment ML starts flirting with FL, it will be cheating unless he breaks up with his girlfriend back on earth...
