Chiwen could have easily snatched the dragon scale from Jiling before our poor red fox swallowed it but he stood silent instead.
Was Chiwen cruel, bad or suspicious? He surely not. He was the son of the Dragon Deity, existed to protect the world.
In the previous episode, Chiwen wanted to find the vessel for his spirit, after his brothers turned into the mountains but it was not an easy task. The dragons created the 10th dragon, Wu Shiguang. They still needed a replacement dragon deity to stay at the dragon's scale cave, until Shiguang got all his power and reclaimed the dragon throne.
The position was initially offered to Commander Yuan, a death sentence at the end of the assignment. Chiwen should have known that Wuhuo had personal entanglement. His regret about Xizai and his protective turned obsession to keep Jiling, who wore Xizai's face, safe. Compared to YWH, Jiling was a pure and kind being, with natural passion to care about & protect others. That was why Chiwen let Jiling be the replacement. That was also Wuhuo's lifetime regret, that Jiling had to suffer a very long time loneliness and an inevitable end just to save him.
