''My dearest'' is based on historical facts and shows the reign of King Injo who was the 16th monarch of Joseon dynasty, while ''Captivating the king'' is not based on actual historical figures thus the king in this drama is a fictional one. Even though the characters are fictional, the customs of Joseon dynasty remain.
Edit: want to add that even though Captivating the king has fictional characters, the story is set few years after the events of My dearest (the invasion of Qing).

Usually adoption happened when concubine has given birth to royal child sooner than queen did. This kind of adoption isn't against law, but it does pose as a threat.
