Plus the reaction of the FL says it all. She did not say "Are you crazy we never slept together and will never sleep together". She said "Even if we have a child...". It means that if they put efforts in it (or not) after they used to not put efforts in it and she becomes pregnant, she would still ask for a divorce. Because having sex and conceiving a child is not relevant to her decision and choice of divorcing.

Why some people are so fixated with the idea that the FL must not sleep with her husband? On the contrary, it helps wit the tragedy of the events. Yes she betrayed ML, slept in the bed she chose and now she regrets it but she is going to be tied in that bed.

When FL chose to marry her prosecutor husband, she knew she will have to sleep with him and she could not refuse forever. After months and months of marriage and bedding together, they did it. The husband said they should start putting efforts in having a child, means they were doing it without focusing on conceiving a child. But they did it.

For the ML it does not matter because after she got married, he still kissed her and asked her to elope with him without knowing if the other guy had her or not. He only considers this feelings. The sexual part, he does not really care or he is too much in love to care.
