My takeaway from this is that if you want to claim justifiable defense you need to have the presence of mind to record while you are in a threatening situation

Although he THOUGHT his life was in danger there was not sufficient evidence to prove that it was (according the the prosecutor anyway) so he acted in excessive defense when he stabbed the guy who was beating him with a stick (I mean beating someone repeatedly with a stick can be deadly but I digress, I don’t know how wide the stick was).

Now it could have been special defense if he had been protecting Mei Zheng from sexual assault, however it seems that when Mei Zheng was giving her testimony to the prosecutors she was reluctant to say that she was in danger of sexual assault. She kept on avoiding the matter and only stated that the blond guy had held her hand and made her feel threatened, the interview stops there as of ep 10. I am assuming when LMF heard her calls for help he thought she was being sexually assaulted while she was not (he was bullying her to teach her a lesson as indicated in episode 10)(this remains to be seen in the upcoming episodes). Therefore, LMFs actions could not be covered by special defense either.

Did she hide the truth so that he got a lighter sentence? If she did there would have been a retrial to charge him with a bigger offence, because they couldn’t establish it was an attempted sexual assault LMF got an excessive defense charge. Her hiding that there wasn’t was inconsequential to the case but LMF believed there was an attempt which made him believe that he had been wronged

Yeah! He could have suffered from a concussion or internal bleeding. Also he was being relentlessly beaten, in addition to this the knife fell between him and his aggressor, should he have just ignored it?

Excessive defense sounds like a bad charge tbh, if someone wants to kill you , are you supposed to gauge how to incapacitate them while you are running for your life?
